<p>Kami berpendapat bahawa ISA merupakan satu undang-undang yang lapuk dan amat tidak berperikemanusiaan. Kami juga berpendapat penahanan YB Manoharan di bawah ISA adalah amat tidak adil kerana beliau hanya merupakan peguambela kepada pemimpin Hindraf yang ditahan oleh polis sahaja dan beliau memang tidak melanggar sebarang undang-undang.<br />

<p>The police moved in to disperse a group of people who had gathered at a field in Ampang Jaya for the launch of an anti-ISA campaign and arrested nine people including a parliamentarian.</p>
<p>Among those who were arrested for allegedly failing to disperse was Salahuddin Ayub, PAS member of parliament for Kubang Kerian.</p>
<p>Police light strike force unit started dispersing the crowd &#8211; numbering less than 100 &#8211; at about 9.26pm just as PAS vice-president Mohamad Sabu started to address the crowd.</p>
<p>By about 10pm, the police managed to remove the people from the field, with the assistance of a heavy downpour.<br />
<span id="more-300"></span><br />
Only a handful of people, armed with umbrellas, remained behind by the edge of the field.</p>
<p>The police meanwhile formed a line to stop people from gaining access to the field. By 10.30pm, the field was totally deserted with the crowd fully dispersed.</p>
<p>In the process, seven protestors were arrested.</p>
<p>Earlier at about 9pm, the police had issued a warning to the crowd to disperse. About 40 Federal Reserve Unit personnel were on standby along with the normal police force.</p>
<p>Mohamad Sabu and PAS Youth chief Salahuddin arrived at the venue at about 9.15pm. Later, Ampang member of parliament Zuraida Kamaruddin was seen to be in negotiation with the police.</p>
<p>Small group at police station</p>
<p>The campaign was organised by the Abolish ISA Movement (GMI) and was to be launched by Opposition Leader Anwar Ibrahim.</p>
<p>According to the organisers, Anwar could not make it to the event.</p>
<p>GMI secretary E Nalini said that among those arrested were three PAS leaders from Kuala Lumpur and Selangor.</p>
<p>Those arrested were taken to the Pandan Indah police station.</p>
<p>A small group of people, led by Mohamad Sabu and GMI chairperson Syed Ibrahim Syed Noh, gathered there in support of those arrested, monitored by a group of 20 policemen.</p>
<p>However, at the police station, Mohamad Sabu and Salahuddin who had gone into the police station to inquire about those arrested were themselves arrested.</p>
<p>Ampang Jaya police chief ACP Abd Jalil Hassan later told the media that the police had to detain the men as they had refused to disperse.</p>
<p>&#8220;We will take their statements before releasing them after an investigation. We had earlier reminded them against holding the illegal assembly but this was ignored,&#8221; he said.</p>
<p>Earlier in the evening, the police had erected roadblock along Jalan Pandan as early as 8pm.</p>
<p>In the run-up to the event, apart from the roadblock, several police vehicles were also seen parked in the vicinity.</p>
<p>According to organisers, the heavy downpour had affected the crowd turnout.</p>
<p>The police had previously advised the organisers not to proceed with the event as there was no police permit for the event.</p>
<p>PJ vigil proceeded smoothly</p>
<p>Meanwhile, a candlelight vigil at the Petaling Jaya Civic Centre tonight attracted about 100 people and proceeded peacefully and smoothly.</p>
<p>This is the second week the vigil &#8211; also held to oppose the ISA &#8211; was being held ‘legally&#8217; with a police permit.</p>
<p>Three weeks ago, the police had dispersed the crowd while breaking up the &#8220;illegal assembly&#8221; and arrested 23 people in the process.</p>
<p>However last week, the organisers were granted a police permit &#8211; with 12 conditions &#8211; to organise the vigil.</p>
<p>The 23 arrested people are to report back to the PJ police station tomorrow morning. </p>

<p>The Shah Alam High Court this morning ruled that the detention of well-known blogger Raja Petra Kamarudin under the ISA was illegal and ordered his immediate release.</p>
<p>Judge Syed Ahmad Helmy Syed Ahmad said that Raja Petra&#8217;s detention was unconstitutional.</p>
<p>He said that the Home Minister had not followed the proper procedure under Section 8 of the ISA to issue the detention order against Raja Petra.</p>
<p>The judge also ordered that Raja Petra, editor of the popular &#8216;Malaysia Today&#8217; website, be produced in court by 4pm today after which he should be immediately released.<span id="more-295"></span></p>
<p>Raja Petra is presently being held at the Kamunting detention centre in Perak.</p>
<p>The ruling by the court followed a habeas corpus application by Raja Petra&#8217;s counsel seeking his release from detention under the security law. </p>
<p>The blogger (left) was arrested on Sept 12 by police and held at an unknown location before he was sent to the Kamunting Detention Camp in Perak on Sept 23.</p>
<p>Home Minister Syed Hamid Albar on Sept 22 had signed a detention order for him to be held under section 8(1) of the ISA. Under the Act, the initial two-year detention period without trial can be renewed indefinitely</p>
<p>Syed Hamid then told reporters that he was satisfied with the reasons given by the police for the blogger&#8217;s detention.</p>
<p>&#8220;The detention is due to Raja Petra&#8217;s articles that ridiculed Islam which could arouse anger among Muslims.</p>
<p>&#8220;The police had recommended his detention and after going through the papers, we are satisfied that there are strong grounds for him to be further detained for two years (in Kamunting),&#8221; he said.</p>
<p>According to his lawyer J Chandra, Raja Petra was arrested for publishing articles on his news portal which allegedly tarnished the leadership of the country and insulted the sanctity of Islam.</p>
<p>The former newspaper columnist had earlier been charged with sedition and defamation after linking Deputy Prime Minister Najib Abdul Razak and his wife to the sensational murder of a Mongolian woman.</p>
<p>It was the second time that Raja Petra had been arrested under the ISA.</p>
<p>He was detained under the draconian law in 2001, at the height of the reformasi movement triggered by the sacking and jailing of former deputy premier Anwar Ibrahim, who is now opposition leader.</p>
<p>However, he was released by the police after 53 days without being sent to Kamunting detention centre. </p>
<blockquote><p><strong>Directions To reach the Bangunan Sultan Salehuddin,</strong></p>
<p>If you get on the Federal Highway, head towards Shah Alam ( after batu tiga toll) 2nd turn off (left). Take 3 o&#8217;clock at roundabout. straight, another round about (Bulatan Kayangan &#8211; can see the Shah Alam mosque right in front) take 12 o&#8217;clock. Then all the way straight &#8211; pass Concorde Hotel (on right), through the traffic lights, and straight on for about 100 m then turn left at Jalan Takbir or towards SUK building. If you miss this turn, drive on for another 100m and turn left at Persiaran Raja Muda (into Sec. 6) then take the first left into Persiaran Sultan.</p>
<p>Or, just look for the tallest building near the Shah Alam Mosque. That would be the SUK building which is where the State Govt is. The court is near it.</p>
<p>To get directly to the SUK building from the Federal Highway, take the 4th turn after the Batu Tiga Toll. (It says it is to Pusat Bandar Shah Alam, or it is the turn right after Pusat Perindustrian Shah Alam.) The road curves into Persiaran Sultan. Just follow this road right to the end.</p></blockquote>

<p>So much is said about justice, truth, and the Rule of Law. Today, distinguished guests, ladies and gentlemen, these words come alive.</p>
<p>An English play entitled &#8220;The Winslow Boy&#8221; by Terence Rattigan tells of a 13-year old boy in the early 1900s, wrongly expelled from the Royal Naval College for allegedly stealing a postal order from a fellow cadet. The College refused to review its decision. The boy&#8217;s only hope was to set forth his request for an open trial in a &#8220;Petition of Right&#8221; which was presented to the King. King Edward VII signed the boy&#8217;s &#8220;Petition of Right&#8221; in May 1909, writing the immortal words: &#8220;Let Right Be Done&#8221;. A few days into the trial it was accepted that the boy was innocent and the family was paid compensation.</p>
<p>Powerful words, &#8220;Let Right Be Done&#8221;. This is why Mr. Yeo Yang Poh, the immediate past President of the Malaysian Bar, called upon the Government in 2006 to review the 1988 Judicial Crisis. He said:</p>
<p>    It is, quite simply, a question of seeking the truth. Are we not interested in the truth? Can we afford not to be? Is the Malaysian society not entitled to the truth?</p>
<p>He also said:<span id="more-283"></span></p>
<p>    This is absolutely crucial, not just for those judges and others who have suffered at the unseen hands of the perversion of justice. This is equally important for the institution of the Judiciary, and indeed for the nation as a whole. History requires the truth, and society demands what is just.</p>
<p>&#8220;Let Right Be Done&#8221;. This is why when we were rebuffed, we proceeded, with three respected organisations, to appoint a Panel of Eminent Persons to review the findings of the two tribunals. The process commenced in September last year.</p>
<p>&#8220;Let Right Be Done&#8221;. This is why we are here today.</p>
<p>It may have taken 20 years but it is never too late for right to be done and for the truth to be told.</p>
<p>The Bar has been steadfast in its support of the Judges whom we knew had suffered a gross injustice in 1988. Not once did the Bar waver despite the attempts made by certain quarters to persuade the Bar to soften our stand against those who helped perpetrate the injustices. Even these attempts were resoundingly defeated by the members of the Bar.</p>
<p>And that is the Bar for you. We have been called many names before – pro-opposition, anti-government, pro-government and recently other names. But our history and our conduct will show that only one label truly describes us, and that is that the Bar is &#8220;pro-justice&#8221;. What we are &#8220;anti&#8221; is &#8220;injustice&#8221;. Those who criticise us must know that we do not speak for ourselves, but for those who are vulnerable and weak and whose voices are not loud enough to be heard. We gain nothing for ourselves personally in being so forthright and we act only in what we believe to be in the public interest. The Bar is a truly Malaysian organisation pursuing the Malaysian dream of a just society.</p>
<p>Recently the Bar has been at the forefront of fighting for judicial reform. Our Walk for Justice, our active participation in the Royal Commission into the videoclip incident, our push for the Judicial Appointments Commission, our setting up of the Panel of Eminent Persons, all point to our absolute commitment to the Rule of Law and the Independence of the Judiciary.</p>
<p>On the 17th of April 2008, the Government had acknowledged the wrongdoing to the Judges affected by the 1988 Judicial Crisis by giving them or their families ex-gratia payments. Although this may have gone a long way towards compensating these Judges for their pain and suffering, it nevertheless left the record against them untouched. Thus the work of the Panel, which had already commenced the previous year, took on greater significance.</p>
<p>There are many who take the view that the events of 1988 should be left in the past and that we should move forward. However, we believe that a process of truth and reconciliation is critical before we can move forward, as the injustices committed in 1988 cannot be left unresolved and unacknowledged in our history. We believe that this is an essential first step in the process of judicial reform.</p>
<p>The purpose of this review must therefore be made clear. We need to learn valuable lessons in order that history does not repeat itself. As George Santayana once said, &#8220;Those who ignore history are doomed to repeat it.&#8221; We seek no punishment. We seek a correction of the record that now stands against these innocent Judges. We seek closure for these respected Judges. We seek closure for our nation.</p>
<p>We would further like to state for the record that although three Judges were ultimately dismissed, six Judges suffered in all. Six Judges were suspended. The three who were ultimately reinstated suffered during their suspension and even when they were reinstated. They were never given due recognition for their flawless years of service on the Bench. Some were potential Lords President or Chief Justices but these positions eluded them. Needless to say, the Judges who were removed paid a heavy price for acting in accordance with their consciences. These Judges acted with courage in upholding the Rule of Law in the face of much adversity.</p>
<p>The Judges who were suspended and dismissed are Tun Dato&#8217; Haji Mohamed Salleh Bin Abas, the late Tan Sri Wan Suleiman Bin Pawan Teh and Datuk George Edward Seah.</p>
<p>The Judges who were suspended but reinstated are the late Tan Sri Eusoffe Abdoolcader, Tan Sri Wan Hamzah and Tan Sri Azmi Kamaruddin.</p>
<p>We, the members of the Bar, salute them.</p>
<p>This report is of tremendous value to us today and for the future. Not only does it set the record straight, its value also lies as a testament to the fact that unjust decisions are always open to scrutiny and those in power will forever remain accountable for their actions. Most importantly its value lies in its reminder to all that such despicable acts must never be allowed to happen again.</p>
<p>And now I will digress a little. I hope you will forgive me for doing so.</p>
<p>We are here to celebrate justice, truth and the Rule of Law. In that celebration we must not forget those who suffer as a result of a violation of these sacred ideals.</p>
<p>I am speaking of those presently held under the dreaded ISA. We say, charge them in court for the alleged offences and give them a chance to defend themselves. Incarcerating them without a trial is a tremendous disservice to the Rule of Law.</p>
<p>I will give you some facts :-</p>
<p>There are currently 66 detainees held under the ISA in Kamunting, many of whom are foreigners.</p>

<p>These are not just names. These are real people with real families whose lives have been thrown into turmoil. We call for their immediate release. I have only read out the names of those held under the ISA. We cannot forget the more than a thousand others held under other preventive detention laws.</p>
<p>And now back to the report of the Panel of Eminent Persons. The Panel comprised: The Hon&#8217;ble Mr. Justice (Retd.) J.S.Verma, former Chief Justice of India, who chaired the Panel; The Hon&#8217;ble Mr. Justice (Retd.) Fakhruddin G. Ebrahim, former Judge of the Supreme Court of Pakistan; Dr. Ms. Asma Jahangir, an advocate of the Supreme Court of Pakistan and the UN Special Rapporteur on Freedom of Religion or Belief; Tan Sri Dato&#8217; Dr. Abdul Aziz bin Abdul Rahman, a senior legal practitioner from Malaysia; Dr. Gordon Hughes, a senior legal practitioner from Australia and former LAWASIA President; and Dato&#8217; Bill Davidson, a senior legal practitioner from Malaysia.</p>
<p>It was critical that the persons chosen to sit on the panel are respected, independent persons of the highest integrity. The backgrounds of the members of this Panel speak for themselves. The report speaks for their high intellectual ability and integrity. We commend this Panel of Eminent Persons for its tireless efforts in producing this historic report before August this year, in time for the 20th anniversary of Tun Salleh Abas&#8217;s dismissal.</p>
